This Privacy Notice has been prepared by Kiğılı Giyim Ticaret A.Ş., as the data controller under the Law No. 6698 on the Protection of Personal Data (KVKK), to inform and enlighten you about which of your personal data will be processed and for what purpose, to whom and for what purpose this processed personal data may be transferred, the method and legal basis for collecting your personal data, and the rights of the personal data owner ("data subject") pursuant to Article 11 of the Law, during your visit to our websites with the address https://www.kigili.com/.

Data Processor: A natural or legal person who processes personal data on behalf of the data controller, based on the authority given by the data controller.

Data Recording System: A recording system in which personal data is processed by structuring it according to specific criteria.

Data Controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system.

Law/KVKK: The Law No. 6698 on the Protection of Personal Data, published in the Official Gazette dated April 7, 2016, and numbered 29677.

Institution: The Personal Data Protection Authority,

Board: Refers to the Personal Data Protection Board.

During your visit to our website;

  • Your IP address, which is included in the Transaction Security data category,
  • For purchases made without registration, your email address, delivery address information, and optionally your mobile phone number, located in the Sales Transactions category,
  • If you register for a Kiğılı Card membership under the Marketing Operations category, your name, surname, email address, and phone number will be collected.
  • If you contact our company via the "Whatsapp Assistant" application, which you can access through our website, your name, surname, mobile phone number, and personal data contained in the information, requests, and comments you send us through this application will be collected from you.
  • You can submit your requests and complaints through our website at https://www.kigili.com/iletisim/  If you contact us through the “Contact Form” on our website, we will only collect your name, surname, email address, and optionally your phone number, along with any other personal data you provide in the contact form.
  • If you contact us through the "Feedback and Suggestion Form" on our website at https://destek.kigili.com.tr/sizi-dinliyoruz, your personal data, including your name, surname, mobile phone number, email address, information about the store where you made your purchase, and the requests you specify in the form,
  • During the inquiry process you conduct via the renovation status inquiry screen located on our website at https://destek.kigili.com.tr/urun-tadilat-sorgulama , you will need your renovation form number or GSM number.
  • When you check your order status on our website at https://destek.kigili.com.tr/siparis-sorgula , your GSM number will be required.
  • When you make an appointment through the https://destek.kigili.com.tr/akilli-alisveris page on our website, you will need to provide your name, surname, phone number, and the city and store information where you will be on your appointment date.

  • You can fill out and submit the Kiğılı Career Journey Form located on our website at https://corporate.kigili.com/kariyer-firsatlari , or you can find information about it on our website.  If you apply for a job by sending an email to ik@kigili.com.tr , your name, surname, information regarding your experience in the applied position, your phone number, your CV, and the personal data you include in the "description" section ( Job Applicant Information Text ) will be processed by Kiğılı Giyim Tic. A.Ş.

  • If you have given your consent, your identity, contact, customer transaction, and marketing data will be processed by our Company for the purposes of customizing and recommending products and services offered to you according to your preferences, usage habits, and needs, and sending you advertisements, promotions, campaigns, and similar commercial electronic communications to your contact information.
  • Your requests, questions, complaints, and suggestions are processed for the purposes of receiving, evaluating, and resolving them.

  • The processing of personal data belonging to the parties to a contract is necessary provided that it is directly related to the establishment or performance of the contract.
  • It is necessary for the data controller to fulfill its legal obligations.
  • It must have been made public by the person concerned themselves.
  • Data processing is necessary for the establishment, exercise, or protection of a right.
  • Data processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

  1.        To Whom and for What Purpose the Processed Personal Data May Be Transferred

Your personal data, which Kiğılı Giyim Tic. A.Ş. declares and undertakes to process in accordance with the "General Principles" set forth in Article 4 of Law No. 6698;

  • IP information is provided to official institutions and organizations such as the Information and Communication Technologies Authority and the Public Prosecutor's Office upon request.
  • When you contact our company via the WhatsApp Assistant application on our website, your personal data processed through the Request and Complaint Form, Feedback and Suggestion Form, Contact Form, Smart Shopping Appointment Form, emails you send to info@kigili.com.tr, personal data contained in invoices and e-invoices, and personal data processed during inquiries you make on the order and shipment status inquiry screen are transferred, upon request, to the Ministry of Trade, the Personal Data Protection Authority, judicial and administrative authorities, our legal advisors to the extent necessary, our cargo and logistics companies we work with for shipment tracking and delivery processes, our suppliers and business partners such as contracted tailors, and our business partners who provide the technical infrastructure for sales and marketing activities and payment systems. Furthermore, while this data is not directly transferred abroad by Kiğılı Giyim Tic. A.Ş., it may be transferred abroad by intermediary service providers such as Meta and Microsoft, acting as "data processors" on behalf of the Data Controller Kiğılı Giyim Tic. A.Ş. Kiğılı Giyim Tic. A.Ş. takes all necessary legal measures to ensure that the transfer of personal data abroad by its business partners, who process data on its behalf, is carried out through one of the methods specified in Article 9/4 of the KVKK (Law on Protection of Personal Data).
  • Your personal data included in the Kiğılı Career Journey Form or in your job applications sent via email to ik@kigili.com.tr is not directly transferred abroad by Kiğılı, but may be transferred abroad through Microsoft, which acts as a data processor and is connected to our email infrastructure. Within Turkey, it will only be transferred to authorized institutions and organizations if requested by them within the scope of a judicial or administrative prosecution and investigation, and to our consulting law firm to the extent necessary for the conduct of legal processes such as termination of employment, payment of compensation, and evaluation of reinstatement requests. Apart from this, personal data of our job applicants is not transferred to any third party or institution.

  1.        Your Rights Under Article 11 of the KVKK (Personal Data Protection Law)

As Kiğılı Giyim Tic. A.Ş., we inform you that you have the following rights under Article 11 of the KVKK (Personal Data Protection Law):

    1. To find out whether your personal data is being processed,
    2. If personal data has been processed, the right to request information regarding this processing.

    3. To learn the purpose of processing personal data and whether it is being used appropriately for that purpose.

    4. Knowing the third parties to whom personal data is transferred, whether domestically or internationally.

    5. The right to request the correction of personal data if it has been processed incompletely or incorrectly, and the right to request the deletion, destruction, or anonymization of personal data if the reasons requiring the processing of personal data cease to exist, within the framework of Article 7 of the KVKK (Law on Protection of Personal Data).

    6. Requesting that data be corrected, deleted, destroyed, or anonymized upon request, and if the data has been transferred to third parties, requesting notification of these actions to third parties.

    7. Objection to an adverse outcome resulting solely from the analysis of processed data by automated systems.

    8. You have the right to claim compensation for damages you have suffered as a result of the unlawful processing of your personal data.

  1.        Application Procedure

In accordance with Article 5 of the Communiqué on the Procedures and Principles for Applications to the Data Controller dated March 10, 2018, in order to exercise the rights set forth in Article 6 of this text , the Data Subject Application Form available on our website must be sent by registered mail or via a notary public, with a wet signature, along with the necessary information to identify the applicant and your explanation regarding the right you wish to exercise, to the following address: Aeropark Yenişehir Mah. Osmanlı Bulvarı No:11/B 34912 - Kurtköy - Pendik/İstanbul Turkey.

Applications must be submitted in Turkish; the request must be clearly stated, without any doubt, which of the rights listed in Article 11 of the Personal Data Protection Law (KVKK) the request is based on; and identity information and relevant documents and information must be attached to the application. Applications made on behalf of third parties must also include a power of attorney appropriate to represent the relevant person. Applications within this scope will be processed free of charge as soon as possible, and within a maximum of 30 days. However, if the process requires additional costs, the fee determined by the Personal Data Protection Board may be requested from you. If the submitted information and documents are incomplete, this period will begin from the date the complete information and documents are submitted. Our company reserves the right to verify your identity before responding to you. Responses may be sent in writing to the applicant's address by any type of postal service or to the e-mail address you have provided, at the discretion of Kiğılı Giyim Tic. A.Ş.

Kiğılı Giyim Tic. A.Ş. reserves the right to make changes to this privacy policy due to possible changes in the KVKK (Law on the Protection of Personal Data) and methods to be determined by the Personal Data Protection Board.
